Our shipping costs reflect US Postal Service Priority mail rates and are calculated based on the ship to address and weight of order.
Please always specify in checkout what date you would like your order delivered on or by. Since most of our items are time sensitive due to being a favor for a specific event, this information is very important. If this information is not included with your order, your shipment can take 2 weeks or more to be delivered due to other priorities.
New York Chocolates is not responsible for lost, undeliverable, misplaced or stolen items once your order has been shipped. You will be provided with a USPS Tracking Number via e-mail when your order is shipped.
Priority Mail is not guaranteed delivery. This means that although delivery is estimated to arrive in 2-3 days from the date of shipment it may arrive later. Please allow additional transit time in addition to actual date of shipment. We do not have any control over this. A tracking number will be provided with all shipments.
It is your responsibility to secure your package upon delivery. Please ensure that the recipient where we are shipping your chocolate order to will be available to receive your order. If the package was delivered on time, but the recipient was not available to accept the package, we will not be responsible for replacing any chocolates or issuing any refunds. We do not recommend that you leave your order outside your door in the heat where it will be exposed to the sun, and/or humidity until you arrive home. Please reconsider having your order shipped to an alternate address such as work or a friend\'s home.
Shipping to a business address - The U.S. Post Office delivers packages Monday through Saturday. If your place of business is closed on a Saturday, the U.S. Post Office will leave a notice of an attempted delivery. They will either redeliver your package on Monday, or request that you pick up your item. We are not responsible for lost, undeliverable, misplaced or stolen items once your order has been shipped.
Hot Weather Shipping - We will provide frozen cold packs during the Summer months or to a warm/hot locations. This is how we prevent our chocolates from melting. Additional costs do apply for additional cold packs upon your request at .75 each, in addition to shipping weight will be added to your total order amount after order is received.
Wrong Delivery by Carrier - We are not responsible if the carrier delivers your order to the wrong address after we shipped it to the correct address as indicated on your order form. Your only recourse of action is to contact your local post master and demand compensation due to the negligence of the U.S. Postal personnel.
Returned Orders - If your package is returned either because it was refused or it was not picked-up by the recipient after failed attempts by the U.S. Postal Service we will NOT issue any credits. It is your responsibility to ensure that your package is picked up at your local post office after notification has been left by the carrier. Refusal of any shipment is unacceptable and unauthorized once an order has been shipped.
Wrong Shipping Address - If your package is returned to us because you provided us with the wrong address we will resend your package with the correct address. We will not be responsible for the additional postage. We will bill you for the additional postage for the original shipping amount. If your order was packed with cold packs and your chocolate items melted during the prolonged shipping transit back to us, we will not issue any refunds (we are not responsible for melted chocolates delivered on time to a shipping address provided by the customer at the time of order). If you feel that the post office was in error, the matter will need to be resolved with your local postmaster in order to receive a refund direct from the post office.
Undeliverable Orders - We are not responsible for undeliverable orders after attempts have been made by the carriers to deliver your order for any reason. Orders are shipped to the shipping address as entered on your original order form by the customer.
Non-Receipt of Merchandise - In the event your order is not received, you must contact us immediately via email so that we may forward package tracking information that you will need to file a claim with your local post office. Please do not initiate a dispute charge with PayPal as this will create a charge back expense to us while we are attempting to obtain a refund on your behalf. If you do, we will submit all proof of shipment documentation to reverse this charge.
If you did not insure your order and it is lost, please contact us first for package tracking information. You will then need to speak with your local Post Master. The carrier will be responsible for issuing a refund to you for your lost order. Please do not contact us for a refund. Our obligation/responsibility was met when we shipped your order.
Damaged Shipments - Do not return damaged items to us, as your refund will be voided with the Post Office. Applicable to insured items only. Insurance must be requested at time of purchase or payment. Please keep a copy of your order claim form number for your records. You must retain the damaged items and all shipping receipts that came with your shipment. You must go to your local Post Office and complete a Damage Claim Form. All forms once they are completed by the customer will be mailed to our local Post Master for verification and sent direct to the U.S. Postal Service Processing Claim Center. It is the responsibility of the U.S. Post Office to mail payment to the customer. Please do not contact us as we do not have this information. For further information, please contact your local post office.
We pack each item carefully for shipping, but occasionally damage is inevitable. We will not issue replacements for damages caused by the carriers. Compensation for your broken items will become the responsibility of the carrier to issue a refund.
Note: *Upon receipt of your order, remove each item carefully. Items are fragile and will break if handled improperly. *Making false & deliberate damage claims for compensational gain is a crime and punishable by law. *Chocolate is a food commodity and for health reasons it cannot be returned.
